Daylight in Conservation Areas: When BRE Targets Bend (2026)

How daylight and sunlight assessments are judged in UK conservation areas in 2026, when BRE targets bend, and how the Appendix F context approach wins consent.

In a conservation area, a daylight and sunlight assessment carries an extra layer of judgement. The BRE numerical targets still apply, but they are read against the grain of the existing townscape — and in dense historic streets those targets sometimes bend. This guide explains when, why and how far.

Conservation areas were designated to preserve character, which often means tight building lines, tall terraces and narrow streets that were never laid out with a 25-degree skyline in mind. A scheme that would comfortably pass BRE tests on an open suburban plot can look like a failure on paper in a historic core — even where it does no more harm than the buildings already there. Understanding how assessors and planners handle that tension is the difference between a refusal and a consent.

Why daylight in conservation areas is judged differently

The starting point is BRE BR 209 (2022), Site layout planning for daylight and sunlight. It sets the familiar tests — Vertical Sky Component (VSC), No-Sky Line (NSL) and Annual Probable Sunlight Hours (APSH) for neighbours, and the internal provision targets of BS EN 17037 for the proposed rooms. Crucially, BRE has always said its numerical guidelines are advisory, not mandatory, and should be applied flexibly according to context. The 2022 edition sharpened that point.

Conservation area status does not change the maths, but it changes the baseline you measure against. In an established dense urban setting, existing daylight levels are frequently already below the open-plot ideal. BRE's own guidance recognises that in these locations lower target values may be appropriate, provided the assessment sets out clear, evidenced reasons.

The "existing context" argument

The most important tool in a historic setting is the alternative-target approach in BR 209 Appendix F. Rather than holding a scheme to the default 27% VSC, an assessor can define a target that reflects what the surrounding townscape actually delivers. If the neighbouring Georgian terrace only enjoys 18% VSC because of the street's own geometry, insisting a new infill building preserve 27% would be asking it to outperform the conservation area itself.

Done properly, this is not a loophole. The assessor models the existing condition, establishes the prevailing daylight character of the street, and tests the proposal against that realistic benchmark. Planners are far more receptive to a transparent, context-based target than to a bare statement that a scheme "fails BRE".

What the planning policy actually says

Two policy strands meet here. The first is amenity: almost every local plan carries a policy requiring development to protect the daylight and sunlight of neighbouring occupiers. The second is heritage: under the NPPF and the Planning (Listed Buildings and Conservation Areas) Act 1990, decision-makers must pay special attention to preserving or enhancing the character and appearance of the area.

Those two can pull in opposite directions. Preserving character may mean matching historic massing and eaves lines — which is exactly what constrains daylight. The December 2025 draft NPPF, with its emphasis on higher-density housing and on making daylight and neighbour amenity a core design test, has intensified this balancing act rather than resolving it. Where the two collide, a well-argued daylight report gives the planning officer the evidence to justify a pragmatic decision.

Sunlight, overshadowing and heritage settings

Sunlight tests (APSH) and overshadowing studies matter just as much in conservation areas, particularly where a scheme sits south of a historic garden, churchyard or public space that contributes to the area's character. Loss of sunlight to a valued amenity space can be a heritage harm as well as an amenity one. The 21 March equinox sun-on-ground test is the standard measure, and it is worth running early so the massing can be adjusted before the design is fixed.

Practical steps for a scheme in a conservation area

  • Model the existing condition first. You cannot argue for a context-based target without an accurate baseline of current daylight in the street.
  • Cite the local plan and any conservation area appraisal. Many appraisals describe the character of streets and spaces in ways that support a realistic target.
  • Keep massing honest. Matching the prevailing eaves and ridge lines is both a heritage virtue and a daylight defence — it shows the scheme does no more harm than the historic grain already does.
  • Report transparently. Set out where the scheme meets BRE defaults, where it does not, and why the alternative target is justified.
