A daylight report for an infill or backland site is rarely a formality. Squeezing a new dwelling into a gap in a street frontage, or onto garden land behind existing homes, puts new walls closer to existing windows than almost any other form of development — and loss of daylight and sunlight is one of the most common reasons these schemes are refused. This guide explains how the BRE tests apply to tight urban plots and what you can do at design stage to pass them.
Infill and backland plots are also exactly where national policy is pushing. The Government's drive for higher densities and 'gentle densification' of existing settlements under the National Planning Policy Framework means more applications on small urban sites — and more neighbour objections about light to deal with.
Why infill and backland sites face the toughest daylight tests
On a greenfield or estate site, the designer controls the separation distances. On an infill plot you inherit them. Three features make these sites hard:
- Neighbours on several sides. A backland plot is typically enclosed by rear elevations and gardens on three or four boundaries, so every facade of the new building is tested against someone's habitable-room windows.
- Short separation distances. Gaps in Victorian and Edwardian streets are often 6–12 m wide. A two-storey wall at that distance can easily breach the BRE's vertical sky component targets for the flanking windows.
- Gardens as well as windows. The BRE guidance protects amenity spaces too. A new house at the end of a garden can overshadow the very gardens that enclose it — see our guide to sunlight to gardens and the two-hour test.
The BRE tests that decide infill and backland applications
Planning officers assess these schemes against BRE report BR 209, Site layout planning for daylight and sunlight (2022). Four checks matter most on a tight plot:
1. Vertical sky component (VSC)
Each neighbouring habitable-room window should retain a VSC of at least 27%, or no less than 0.8 times its existing value. On narrow plots the 0.8-times ratio is usually the decisive number — our 0.8 times rule guide explains why a 20% loss is the practical ceiling.
2. No-sky line (NSL)
Where the new building is close and directly opposite, the area of a neighbouring room that can see the sky should not fall below 0.8 times its former value. Deep rear rooms in period terraces often sit near the threshold already.
3. Annual probable sunlight hours (APSH)
Windows facing within 90 degrees of due south are tested for sunlight. Backland dwellings sited to the south of existing gardens and living rooms are the classic APSH failure. The three metrics are unpacked in VSC, NSL and APSH explained.
4. Daylight within the new dwelling
The tests cut both ways: the new home must itself receive adequate daylight under BS EN 17037 and the BR 209 provision checks. An enclosed backland plot can fail its own bedrooms even where the neighbours pass — a point councils increasingly check for single-aspect and heavily enclosed layouts.
Design moves that get tight plots through
Most infill refusals on daylight grounds are avoidable if the massing is tested before the application is submitted:
- Step the building down towards boundaries. Single-storey or one-and-a-half-storey elements next to the closest neighbouring windows protect VSC where it is most at risk.
- Use roof form, not floor area, to find volume. A 45-degree pitched roof away from the boundary preserves far more sky visibility than a flat-roofed box of the same floorspace.
- Orient habitable rooms to the open aspect. Put stairs, bathrooms and storage against the enclosed boundaries and living rooms towards the street or the longest garden dimension.
- Test the gardens early. At least half of each retained garden should still receive two hours of sun on 21 March; a simple massing study will show whether the scheme fails before any neighbour sees it.
- Use context-based targets where justified. In dense urban areas BR 209 Appendix F allows alternative targets based on the prevailing context — but they must be evidenced, not asserted.

What councils expect to see with the application
For a contested infill or backland scheme, most authorities now expect a daylight and sunlight report with the submission rather than after objections arrive. A proper report models the existing and proposed condition in 3D, runs the VSC, NSL, APSH and overshadowing tests, and — importantly for these sites — explains any transgressions in context. Officers give weight to a report that acknowledges a marginal breach and justifies it against the pattern of the street, far more than one that claims everything passes.
